1. Agreement to Terms

By downloading, installing, accessing, or using the PinPals mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you may not use the App.

PinPals reserves the right to modify these Terms at any time. Your continued use of the App following any changes constitutes your acceptance of the new Terms.

2. Description of Service

PinPals is a location-based social application that enables users to:

• Share approximate location proximity information with friends
• Create and view location-based "pins" (event markers) for coordination
• Manage friend connections and location sharing preferences
• Send status updates and create event RSVPs
• Receive push notifications about friend activities and nearby events

3. User Eligibility and Accounts

3.1 Age Requirements

You must be at least 13 years of age to use PinPals. If you are under 18, you represent that you have obtained parental or guardian consent before using the App.

3.2 Account Registration

To use the App, you must create an account with accurate, current, and complete information, including:

• First and last name
• Valid email address
• Phone number
• Secure password

You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.

3.3 Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms or for any reason at our sole discretion, with or without notice.

4. Location Data and Privacy

4.1 Location Permission

To use PinPals, you must grant the App permission to access your device's location services. You may revoke this permission at any time through your device settings, but doing so will limit App functionality.

4.2 Location Sharing Control

You have full control over location sharing:

• You may enable or disable location sharing at any time
• You may selectively share location with specific friends
• Muting a friend prevents them from seeing your location
• Disabling location sharing hides your location from all users

4.3 Accuracy and Limitations

PinPals provides proximity-based information, not precise GPS tracking. Location accuracy depends on device capabilities, signal strength, and environmental factors. We do not guarantee location accuracy or real-time updates.

5. Permitted Use

You agree to use PinPals solely for lawful purposes and in accordance with these Terms. Specifically, you agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Harass, threaten, abuse, defame, or harm other users
• Impersonate any person or entity or misrepresent your affiliation
• Engage in spam, flooding, or unsolicited messages
• Attempt to gain unauthorized access to the App or other users' accounts
• Reverse engineer, decompile, or attempt to discover the App's source code
• Use automated tools to scrape or collect data without authorization
• Share location data with third parties without authorization
• Use the App for stalking, tracking, or surveillance purposes
• Create multiple accounts to evade suspension or restrictions
• Post sexually explicit, violent, or illegal content

6. Friend Requests and Connections

6.1 Connection Requirements

You may only share location with users who have accepted your friend request or vice versa. Unsolicited location sharing requests may be declined without explanation.

6.2 Friend Removal

You may remove friends at any time. Upon removal, the former friend will no longer see your location or status updates.

6.3 Muting

You may "mute" friends, which prevents them from viewing your location while maintaining the friend connection.

7. Content and Conduct

7.1 User-Generated Content

You are responsible for all content you create and share through PinPals. You retain ownership of your content, but grant PinPals a non-exclusive license to use, store, and display your content to authorized users.

7.2 Content Standards

You agree that your content will not:

• Infringe on intellectual property rights
• Contain malware, viruses, or harmful code
• Be obscene, defamatory, or discriminatory
• Promote illegal activities or violence
• Violate privacy or confidentiality rights

8. Pins and Events

Pins are location-based markers created by users to coordinate meetups or share activities. You are responsible for:

• Ensuring pins contain accurate information
• Respecting private property when creating location-based pins
• Not creating pins for illegal or harmful purposes
• Not spamming or creating excessive pins

We reserve the right to delete any pin that violates these Terms.

9. Disclaimer of Warranties

10. Limitation of Liability

To the fullest extent permitted by law, PinPals shall not be liable for:

• Indirect, incidental, consequential, special, or punitive damages
• Loss of profits, data, revenue, or business opportunities
• Damage to property or personal injury
• Unauthorized access or use of your account
• Inaccurate or delayed location information
• Third-party actions or content

Total liability cap: Our total liability shall not exceed the amount you paid for the App (if any) in the 12 months prior to the claim.

• Tell others where you're going
• Trust your instincts
• Report suspicious behavior immediately

12. Privacy

Your use of PinPals is governed by our Privacy Policy. Please review it for information about data collection, usage, and your privacy rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where PinPals is incorporated, without regard to conflict of law principles.
